Welcome to NjiaKazi. These Terms of Service govern your use of our website, platform, and services. Please read them carefully before accessing or using our services.
1. Acceptance of Terms
By accessing and using the NjiaKazi website and services ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including job seekers, employers, recruiters, and visitors. We reserve the right to update these Terms at any time, with changes effective upon posting. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. User Accounts
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Platform or its users.
3. Job Listings
Employers and recruiters posting job listings on NjiaKazi must ensure all information is accurate, complete, and not misleading. Job listings must represent genuine employment opportunities. We prohibit postings that: (a) require payment from job seekers; (b) contain false or misleading information about salary, requirements, or working conditions; (c) discriminate based on protected characteristics; (d) are not actual job openings (including "bait-and-switch" listings); or (e) violate any applicable laws or regulations. NjiaKazi reserves the right to review, modify, or remove any job listing at our discretion. We do not guarantee the accuracy of any job listing and are not responsible for the actions of employers or recruiters.
4. Job Applications
By applying to a job through NjiaKazi, you acknowledge that NjiaKazi is not a party to any employment relationship or agreement between you and any employer. We do not guarantee that your application will be viewed, that you will receive a response, or that you will be hired. You are responsible for verifying the legitimacy of any employer before providing personal information or accepting any offer. NjiaKazi is not responsible for the outcome of any application or interview process.
5. Payments and Fees
Certain features of the Platform, including career services and premium employer features, may require payment. All fees are clearly displayed before purchase and are non-refundable unless otherwise stated. We process payments through secure third-party payment processors and do not store full payment card information. You agree to pay all applicable fees and taxes associated with your use of paid services. In the event of a payment dispute, contact our support team before initiating a chargeback.
6. Intellectual Property
All content, features, and functionality of the NjiaKazi Platform — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — are the exclusive property of NjiaKazi or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent.
7. User Content
By submitting content to the Platform — including resumes, cover letters, job listings, company profiles, reviews, or messages — you grant NjiaKazi a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing and promoting the Platform. You represent that you have all necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws. We reserve the right to remove any user content at our discretion.
8. Prohibited Conduct
You agree not to: (a) use the Platform for any unlawful purpose or in violation of these Terms; (b) submit false, inaccurate, or misleading information; (c) attempt to gain unauthorized access to any part of the Platform or its systems; (d) use automated tools (bots, scrapers, etc.) to access or collect data from the Platform without our express written permission; (e) interfere with or disrupt the Platform or its servers; (f) impersonate any person or entity; (g) harass, threaten, or harm other users; or (h) post content that is defamatory, obscene, or otherwise objectionable. Violation of these provisions may result in immediate account termination and legal action.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NJIAKAZI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO NJIAKAZI IN THE TWELVE MONTHS PRECEDING THE CLAIM. The Platform is provided on an "as is" and "as available" basis without warranties of any kind.
10. Indemnification
You agree to indemnify, defend, and hold harmless NjiaKazi and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.
11. Termination
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, limitation of liability, and indemnification.
12. Third-Party Links
The Platform may contain links to third-party websites or services that are not owned or controlled by NjiaKazi. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that NjiaKazi is not responsible or liable for any damage or loss caused by or in connection with your use of any third-party content, goods, or services.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any legal action arising out of or relating to these Terms or your use of the Platform shall be brought exclusively in the courts of Nairobi, Kenya. You consent to the personal jurisdiction of such courts.
14. Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us and attempt to resolve the dispute informally. If the dispute cannot be resolved informally within 60 days, either party may pursue available legal remedies. Any claim must be brought within one year of the event giving rise to the claim.
15. Miscellaneous
These Terms constitute the entire agreement between you and NjiaKazi regarding your use of the Platform. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
